CIC MOBILE APP: TERMS AND CONDITIONS

1. ACCEPTANCE OF OUR TERMS AND CONDITIONS
Our Mobile Application and Platform are designed to be used solely by our member, being associate member or qualified member. All members are required to have their individual account with our Mobile Application. We will be in charge of creation of individual account for all members (Hereafter called “User”). User may activate his/her account in our Mobile Application in order to use our service and available information provided, (hereafter called “Active User”). These Terms and Conditions shall automatically apply to all active users from the date of activation of their account without any further confirmation being needed. Once Members opt to use our Mobile Application by creating an account, they shall forthwith and without reserve accept these Terms and Conditions and our Privacy Policy. If active user wishes not to follow these Terms and Conditions afterward, they may simply deactivate their account from our Mobile Application.

2. PROVIDED SERVICE
Active user will have access to our service and other available information provided in our Mobile Application as following: accessing to CiC Members directory, CiC performance report, CiC Knowledge and publication, being updated when there is any announcement, and other relevant services as added and/or developed by CiC from time to time. Moreover, our Mobile Application is a platform where active user may also file his/her application for subscribing the unit trust of Fund. The identification of Fund(s) available for online subscription request, shall be made by CiC from time to time on Platform, and the process for the treatment of subscription request as well as allotment thereof to online applicant, where all conditions are duly met, shall be done offline.
We, as administrator of our Mobile Application and the Platform, reserve the rights for discretionary management of the main menu as well as the structure of our Mobile Application and Platform.

3. REQUIREMENTS FOR THE USE OF OUR MOBILE APPLICATION
When creating an account, our Mobile Application and Platform will require active user to provide us with his/her personal data, including but not limited to phone number, name, unit trust subscription, email, personal and corporate address, gender, contact, occupation, social media account (if any) and other relevant data. We will use that provided personal data in order to give active user a good experience of using our Mobile Application and Platform. We will treat the user’s personal data according to applicable law and regulations. We invite Users to consult our Privacy Policy for the detail of how his/her personal data are treated.

By activating his/her account in our Mobile Application, active user agrees to set up a strong password, not provide access to third-party, use their account in good conduct that will not expose any risks to our Mobile Application and Platform and/or other users.

4. USER PERMISSION
By activating his/her account in our Mobile Application, User agrees to provide us with authorization, including but not limited to access to his/her account/profile and other relevant and appropriate access for reason of security and/or good functioning of the Platform.

We will send active user via our Mobile Application the notification/message of any update of our service that may affect and/or benefit the active user interest, including but not limited to the update of our Terms and Conditions, the update of our Privacy Policy, introduction of our new service, alert of unusual log in of User’s account, and other relevant notification/message.

In our Mobile Application and Platform, active user may manage to keep his/her account private or disclose his/her personal data to be viewed by other active users. In the earlier case, active user’s personal data will not be shown in the search engine, be viewed by other active users. In the latter case, active user will have their public profile that may be viewed by other active users. However, active user may limit access to his/her personal data in his/her public profile. The privacy setting as above provided shall be done in the manner as instructed in the Platform.

Active user may use the pseudonym in his/her public profile. The pseudonym should be his/her nickname, pen name, ring name or other names which shall not be contrary to the public order, morality or prejudice any other persons such as celebrity, public figure or political figure. Also, where active user is allowed to fill in personal data, active user warrant under his/her sole responsibility the accuracy and genuineness thereof; should there be any issue with public order, morality or infringement or other legal issue, we reserve the rights to inter alias delete such data without prior notice, and without prejudice to our rights of claims and/or to compensation.

5. INTELLECTUAL PROPERTY AND PROPRIETARY
This Mobile Application, Platform and their contents are the sole proprietaries of CiC. The use of this Mobile Application, Platform and their contents shall be in accordance with these Terms and Conditions.
The use of the contents on our Platform by Active User shall be a personal and non-commercial use. The active user consents not to communicate these contents to a third-party in any form or purpose or the make use of such contents in whole or in part for any purpose or cause, except those as explicitly authorized hereunder.

6. UPDATE TERMS AND CONDITIONS
We reserve the rights to update/change/dismantle our Terms and Conditions and our Privacy Policy at any time and at our sole direction without prior notice and liability to active user or to the third-party.
Upon our Terms and Conditions and our Privacy Policy having been updated/changed, we will notify the User of such update/change. The User may object to any update/change of our Terms and Conditions and our Privacy Policy. In doing so, the active user shall deactivate his/her account and no longer access to our service in our Mobile Application and Platform. Continued use of our Mobile Application and Platform constitutes an acceptance of any update/change of our Terms and Conditions and our Privacy Policy.

7. LIMIT OF LIABILITY
We do not warrant that our Mobile Application and Platform will be available for the active user to have access anytime or from any location. We will try our best to provide active user with good service and up to date of our Mobile Application. Should there be any difficulties to access and/or use our Mobile Application and Platform, please feel free to reach us via the help center.

We do not warrant the accuracy of the contents in our Mobile Application and Platform. Our report and other publications in our Mobile Application and Platform are solely for information purposes and do not constitute the recommendations or advice to purchase or withdraw the unit trust. In case active user seeks for any professional recommendations or advice, active user is advised to consult with experts in relevant fields. Notwithstanding the foregoing, our intellectual property rights on the contents thereof shall fully be protected.

The User shall be solely responsible if there is the demonstration of active user’s failure to follow our Terms and Conditions and our Privacy Policy and such failure causes damages to other users or third-party. Any malicious action and/or attempt regarding the use, or undertaking under any form, of our Platform/Mobile Application shall expose the offender to full legal responsibility, both civilly and criminally.

8. ACCOUNT SUSPENSION
If we find that active user violates our Terms and Conditions and our Privacy Policy, we will send active user first notice to alert him/her of such violation.
In case there is a second violation of our Terms and Conditions and our Privacy Policy within a month, counting from the first notice of violation, we reserve the right to suspend the account in question temporarily. In such a case, we will send the User the notification of temporary suspension of his/her account.
If there are 3 (three) consecutive violations of our Terms and Conditions within 3 (three) months, we reserve the right to suspend the User account permanently without prior notice to active user.
Notwithstanding the above provision, in case of serious misconduct of active user or other serious dysfunctions of account that may results from the cyberattack, we reserve the rights to suspend immediately active user account without prior notice. We also reserve the rights to take other measures which are appropriate and in compliance with applicable law and regulation and these terms and conditions.
We reserve the rights to transfer the Mobile Application and Platform management to the third-party that we deem fit, provide that our Terms and Conditions and Privacy Policy are still applicable. With this regard, the third-party may suspend user account in above hypothesis of violation.

9. DISPUTES
Our Terms and Conditions and Privacy Policy shall be governed by and construed with the Law of the Kingdom of Cambodia.
In case any disputes are arising between us and User with respect to our Terms and Conditions and our Privacy Policy, Users agree to resolve those disputes amiably prior to filing the complaint before the competent authority. The competent authority is the competent jurisdiction of the Kingdom of Cambodia.
